This Privacy Policy also describes how we use and share such information, how we protect the security of such information, and how you may change or request that we amend such information or remove such information from our systems. This includes any “Personal Information” associated with you that is supplied to us in connection with your use of our Website or information we generate regarding your use of the Website. “Personal Information” means any information that does, or can be used to, identify you, such as your name, title, email address, phone number, home address or computer IP address. This Privacy Policy applies solely to your use of the Website. Our Website contains links to third-party sites, and we are not responsible or liable for the privacy practices or content of such third-party sites since we do not control them.

The Personal Information We Collect on Our Website

In general, we may collect this Personal Information when you fill out a contact form, download a white paper, request a product demonstration, participate in a marketing survey or campaign, apply for a job, or communicate with Evolv via the Website. Our Website includes social media features, such as, Facebook, Twitter and LinkedIn buttons. These features may collect information, including (but not limited to) your IP address, which page you are visiting, and may set a cookie to enable the feature to function properly. We also collect information automatically from our customers and Website users, as described below.

Website Visitors

We may maintain a log of certain information concerning visitors to our Website, including but not limited to, a visitor’s IP address (a computer’s numerical Internet address), the websites from which visitors access our Website, the type of web browsers used to access our Website, the device used to access our Website, and the pages viewed. We only use this type of information to understand how our Website is accessed, how it is used and how we may improve our Website.

Like most internet sites, Evolv may use session ID cookies and persistent cookies, as well as other tracking technologies, to compile statistics on Website users. Cookies are alphanumeric identifiers containing a string of characters that is sent to your computer for record-keeping purposes when you visit our Website. Some cookies allow us to make it easier for you to navigate our Website, while others allow us to track your Website usage including, page(s) you visit, and keyword searches you conduct. Do-Not-Track

Our Website does not currently recognize and process “do not track” signals from different web browsers.

Third-Party Analytics

We use certain automated devices and third-party applications such as Google Analytics and HubSpot tools to evaluate usage of our Website and email marketing. Evolv may also use other analytic means to evaluate our Website and to help us improve performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. This Privacy Policy does not cover such third parties’ use of data.

How We Use Information Collected on Our Website

You agree that your use of the External Websites is at your sole risk and that Evolv shall not have any responsibility for nor any liability to you for any content or function of the External Websites.

Employment Opportunities

We provide you with access to a third-party service provider to submit means for submitting your resume or other Personal Information to us for consideration for employment opportunities at Evolv. Personal Information received through resume submissions will be kept confidential. We may contact you for additional information to supplement your resume, and we may use your Personal Information within Evolv, or keep it on file for future use, as we make our hiring decisions.

Retention of Information

We will retain your Personal Information for as long as it is needed to provide you the services it was collected for and as necessary to comply with any legal obligations, resolve disputes, enforce our agreements, or as otherwise reasonably necessary for our internal business purposes. When it is no longer necessary to retain your Personal Information, we will securely destroy it in accordance with applicable laws. We may retain anonymized or pseudonymized, aggregated data indefinitely, to the extent permitted under applicable law.

Children

We do not knowingly collect Personal Information from individuals under age 13. Anyone under 13 should not use the Website. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information.

Evolv is headquartered in the United States and may process and store information on servers located in the United States. You have the right to opt-out of the sale of Personal Information; however, Evolv does not sell or rent any Personal Information to any third parties.

We will process the above rights requests in accordance with applicable law. To process your request, we may need to verify your identity in order to avoid fraudulent requests and ensure you are the California resident who is making the request. To properly verify your identity, we may ask you to provide some information that we can attempt to match with Personal Information we may have about you. This may include your full name, your phone number, and/or your email and/or postal address. Once a request is verified, we will search our internal systems for any of your Personal Information that we may have. Once we have located any of your Personal Information, we will work to comply with your applicable request.

You have the right to appoint an agent who is registered with the Secretary of State of California to submit requests and exercise the above rights on your behalf. We may require the agent to submit to us written permission from you as well as have you verify your identity directly with us. In the event an agent is not able to provide written permission to act on your behalf, we are within our rights to deny a rights request.

Class Action Waiver

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Dispute Resolution

Except as otherwise required by applicable law, you agree that any dispute, controversy, or claim arising out of or relating to this Privacy Policy or the collection, use, storage or transfer of any of your information or data, including, but not limited to, the arbitrability of the matter or the formation, interpretation, scope, applicability, termination, or breach of this Privacy Policy, shall be referred to and finally determined by arbitration in accordance with the JAMS Streamlined Arbitration Rules and Procedures, or JAMS International Arbitration Rules, if the matter is deemed “international” within the meaning of that term as defined in the JAMS International Arbitration Rules. The arbitration shall be administered by JAMS, shall take place before a sole arbitrator, and shall be conducted in Boston, MA. If the JAMS International Arbitration Rules apply, the language to be used in the arbitral proceedings will be English. Judgment upon the arbitral award may be entered by any court having jurisdiction. This section shall apply to and require arbitration of all disputes, controversies, and claims, regardless of whether such disputes, controversies, or claims concern a single individual, entity, or other person, multiple individuals, entities, or other people, or classes of individuals, entities, or other people. You hereby consent to receive service of process by electronic means or social media to the extent allowed by the applicable court. This constitutes express agreement of the parties regarding your consent pursuant to United States Federal Rule of Civil Procedure 5(b)(2)(E) and any applicable state (or other jurisdiction) equivalent.
